Extended Cancellation

Subject to the following Terms and Conditions, if You purchase the “Extended Cancellation” amenity in connection with Your booking of ground transportation services through Mozio (“Extended Cancellation”), You may cancel the eligible reservation(s) for any reason and receive the refund amount displayed in the booking flow at the time of purchase, provided that all conditions of these Terms and Conditions are satisfied.

By purchasing Extended Cancellation, You agree to be bound by these Terms and Conditions. If You do not agree to these Terms and Conditions, You may not purchase or use Extended Cancellation.

Extended Cancellation is personal to the booking for which it is purchased, is non-transferable, non-assignable, and may not be applied to any reservation other than the reservation(s) purchased in the same transaction as Extended Cancellation.

All cancellation requests made under Extended Cancellation must be submitted directly to Mozio in accordance with these Terms and Conditions, and not to the relevant service provider.

1. Eligibility and deadline

To use Extended Cancellation, You must submit Your cancellation request online through Mozio’s self-service portal no later than thirty (30) minutes before the original scheduled pickup time of the relevant ride segment.

Extended Cancellation expires automatically once fewer than thirty (30) minutes remain before the original scheduled pickup time of the relevant ride segment. After such time, the reservation will no longer be eligible for cancellation under Extended Cancellation, and any cancellation will be subject to the standard cancellation terms applicable to the booking, which may include a charge up to the full value of the reservation.

2. How cancellation works

Extended Cancellation is purchased once per booking and applies only to the reservation covered by that booking. Subject to these Terms and Conditions, it covers each eligible ride segment included in that booking at the time of purchase.

Cancellation under Extended Cancellation must be completed online through Mozio’s self-service portal, except as expressly provided otherwise in this Section.

If the booking includes multiple passengers, cancellation of a booked service under Extended Cancellation will apply to all passengers included in the canceled booking or canceled segment, as applicable. Partial passenger cancellations are not permitted.

If permitted by the booking flow or self-service portal, Extended Cancellation may be exercised with respect to one or more eligible ride segments of a multi-segment itinerary, while the remaining segment(s) are kept in place. In that case, the cancellation will apply only to the selected eligible segment(s), but always for all passengers on the canceled segment(s).

Where Extended Cancellation is exercised for fewer than all eligible ride segments in the booking, the refund amount shall be prorated to reflect only the canceled eligible segment(s), in accordance with the refund methodology or amount displayed in the booking flow at the time of purchase, subject always to any applicable maximum refund stated in these Terms and Conditions.

For the avoidance of doubt, the cancellation of one eligible ride segment under Extended Cancellation shall not, by itself, cancel or alter any other segment in the same booking that is not expressly canceled.

3. Refund amount

If You validly cancel an eligible reservation or eligible ride segment in accordance with these Terms and Conditions, You will receive the refund amount displayed in the booking flow at the time You purchased Extended Cancellation for the relevant booking, excluding the fee paid for Extended Cancellation itself.

If Extended Cancellation is exercised for only part of a multi-segment booking, the refund shall be prorated so as to correspond only to the canceled eligible segment(s), and no refund shall be due for any segment that is retained.

Notwithstanding the foregoing, the maximum refund payable under Extended Cancellation shall in no event exceed USD $750 in the aggregate per booking.

Extended Cancellation applies only to the service booking(s) purchased in the same transaction as Extended Cancellation. Any products or extras added after the original booking is completed, including for example child seats, meet-and-greet services, or similar ancillary items, are not refundable under Extended Cancellation unless expressly stated otherwise in the booking flow.

4. Refund method and timing

Where a refund is due under Extended Cancellation, Mozio will initiate the refund automatically to the same payment method used for the original booking, unless otherwise required by applicable law. Refund processing will begin after the cancellation is successfully completed online, but the funds may take up to ten (10) business days, or longer depending on the payment provider or financial institution, to appear in Your account.

If the self-service portal is unavailable, inaccessible, or otherwise cannot process the cancellation request due to a technical issue, outage, or error, whether affecting Mozio or a third-party system used to support the cancellation flow, You shall not be entitled to exercise Extended Cancellation by other means unless Mozio expressly states otherwise in writing. In such circumstances, if the technical issue prevents You from using Extended Cancellation within the applicable deadline, Your sole remedy shall be a refund of the fee paid for Extended Cancellation, and no refund shall be due in respect of the underlying booking or any ride segment.

5. Effect of cancellation; assignment of rights

If You exercise Extended Cancellation and receive a refund from Mozio under these Terms and Conditions, neither You nor any passenger included in the canceled booking shall be entitled to seek, claim, or retain any duplicate refund, reimbursement, compensation, credit, or other recovery from the service provider in respect of the same canceled services.

To the extent any right to a refund, reimbursement, credit, charge reversal, compensation, or similar recovery exists against the service provider in relation to a booking or ride segment canceled under Extended Cancellation, You agree that such right is, to the maximum extent permitted by law, automatically assigned to Mozio upon payment of the refund by Mozio.

You agree to provide Mozio with such reasonable cooperation, information, documentation, and assistance as Mozio may request in order to verify eligibility, investigate the cancellation, defend any chargeback or payment dispute, or pursue any recovery from the service provider or other relevant third party.

Where a refund is paid under Extended Cancellation, You shall not initiate, maintain, or knowingly permit any chargeback, payment dispute, or other reversal request in relation to the same refunded amount. If any such chargeback, payment dispute, or reversal is initiated and Mozio determines, acting reasonably, that it relates to an amount already refunded under Extended Cancellation, Mozio reserves the right to reject the claim, recover the duplicated amount, or offset such amount against any sums otherwise owed to You, to the extent permitted by applicable law.

6. Exclusions

Extended Cancellation does not apply, and no refund shall be due under it, in any of the following circumstances:

a. Changes or cancellation made outside Mozio. Before You submit a cancellation request under Extended Cancellation, the relevant service has been canceled, modified, rescheduled, or otherwise changed directly with the service provider and not through Mozio.

b. Force Majeure cancellation by the service provider. Before You submit a cancellation request under Extended Cancellation, the relevant service has been canceled by the service provider due to Force Majeure.

For purposes of this Section, “Force Majeure” means an event beyond the reasonable control of the affected party that could not have been avoided by reasonable measures and that prevents performance of the transportation service, including, without limitation, natural disasters, severe weather, acts of government, airport or port closures, labor disruptions or strikes, war, terrorism, civil unrest, epidemics, pandemics, widespread technology outages, or cybersecurity incidents.

c. Prior service-provider cancellation for other reasons. Before You submit a cancellation request under Extended Cancellation, the relevant service has already been canceled by the service provider for reasons other than Force Majeure, and the service provider has not rebooked the service or directly confirmed or issued a refund to You.

d. Late request. You do not submit the cancellation request at least thirty (30) minutes before the original scheduled pickup time of the relevant ride segment.

e. Provider insolvency or service cessation. Before You submit a cancellation request under Extended Cancellation, the service provider has become insolvent, ceased trading, suspended operations, or otherwise stopped providing the relevant travel services.

f. Used, commenced, or completed service. The relevant ride segment has already commenced, has been completed, or the passenger has been picked up or marked as a no-show.

g. Fraud, misuse, or abuse. Mozio reasonably suspects fraud, misuse, abuse, bad faith, or a breach of these Terms in connection with the booking or the use of Extended Cancellation.

7. Fee for Extended Cancellation

The fee paid for Extended Cancellation is non-refundable, except otherwise specified, in which case You shall be entitled only to a refund of the fee paid for Extended Cancellation and no additional refund under this Section.

8. No insurance

Extended Cancellation is an optional contractual cancellation amenity offered by Mozio. It is not insurance, does not provide insurance coverage, is not intended to constitute an insurance policy, and shall not be construed as such.

9. Interpretation

In the event of any conflict between these Terms and Conditions and the standard cancellation terms otherwise applicable to the booking, these Terms and Conditions shall govern solely with respect to the use of Extended Cancellation.

Nothing in these Terms and Conditions limits any mandatory consumer rights that cannot be excluded under applicable law.

10. Modification of the Terms

Mozio reserves the right, at their discretion, to change the Terms and Conditions on a going forward basis at any time. Please check the Terms and Conditions periodically for changes.

Your continued use of the Service after the changes become effective constitutes your binding acceptance of such changes. In the event that a change to the Terms materially modifies your rights or obligations, we will make an effort to notify you of the change, such as by sending you an email to the address we have on file for you, or presenting a pop-up window or other notification to you through the Service when you log in. Immaterial modifications are effective upon publication, and material changes will be effective upon the earlier of (a) continued use of the Service with actual knowledge of the modification, or (b) thirty (30) days following the change.

For the avoidance of doubt, disputes arising hereunder will be resolved in accordance with the Terms and Conditions in effect at the time the dispute arose.
